The EHHA Board is proposing an amendment for approval to the Declaration of Protective Covenants of Emerald Hills Subdivision of Butler County, Ohio, filed in Volume 1608, page 454 with the Butler County Recorder. This amendment is to establish parameters regarding short-term rentals. If approved, this amendment will be filed as an amendment to the Protective Covenants of Emerald Hills Subdivision with the Butler County Recorder within 30 days.

Your vote must be submitted August 31, 2024.

Amendment 7

20.0 RENTING AND LEASING

The Owner of any Lot or any first mortgage in possession of any Lot shall have the right to lease the lot and dwelling subject to the conditions set forth herein. Notwithstanding, the dwelling may not be rented for transient or hotel purposes which shall be defined as rental for any period less than three hundred sixty five (365) days. Subleasing is not permitted. All leases of any dwelling shall be in writing. All such leases shall provide that they are subject to all the provisions of the Declaration, the By-Laws, and Rules and Regulations adopted by the Association. Any failure by the lessee to comply with such provisions shall constitute a default under the terms of the lease. Any Owner wishing to lease the dwelling must notify the Board or the designated property manager acting on behalf of the Board of the intention to lease. The form of the lease must be approved by the Board prior to any execution of the lease and a copy of the lease kept on record with the Association.
